Terms of Service

1. Agreement

These Terms of Service (“Terms”) are a binding agreement between you and ParkCharter, operated by Park Charter LLC, a limited liability company based in the United States (“ParkCharter,” “we,” “us”). By creating an account or using parkcharter.app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. What ParkCharter is

ParkCharter is an AI-powered trip planning tool for Walt Disney World and Universal Orlando. We are not affiliated with, endorsed by, or sponsored by The Walt Disney Company, Universal Studios, or any of their subsidiaries. All park names, attraction names, and related marks belong to their respective owners and are used only for identification.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or make a purchase. If you include minors in a trip profile, you represent that you are their parent or legal guardian.

4. Accounts

You are responsible for keeping your password secure and for all activity under your account. Notify us at support@parkcharter.app if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or are used abusively.

5. Plans, pricing, and billing

Current plans:

  • Free — 1 day, 1 park, one lifetime itinerary generation, 5 AI chat messages.
  • Per Trip — $14.99 one-time, up to 10 days, full AI features, PDF export, and budget optimizer.
  • Planner Pass — $9.99/month billed annually ($119.88/year), everything in Per Trip plus unlimited trips and unlimited re-plans.

Payments are processed by Stripe. Prices are in U.S. dollars and may change; changes will not affect a purchase already made. Planner Pass renews annually unless cancelled before the renewal date.

6. Refunds

Per Trip: refundable within 7 days of purchase if you have not generated more than one itinerary. Planner Pass: refundable within 14 days of initial purchase if you have not generated more than two itineraries. Renewals are non-refundable but you may cancel at any time to prevent future charges. Refund requests: support@parkcharter.app.

7. AI-generated content and accuracy

Itineraries, recommendations, wait times, schedules, and other information are generated by AI and third-party data sources. They may be inaccurate, incomplete, or out of date, especially regarding park hours, ride availability, refurbishments, show times, menus, prices, and dining reservation windows.

Always verify critical details with the official Disney and Universal apps and websites before making travel decisions, purchases, or reservations. ParkCharter is a planning aid, not an official booking system, and cannot make reservations on your behalf.

8. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose
  • Scrape, reverse-engineer, or resell the service or its AI outputs
  • Attempt to bypass rate limits, free-tier limits, or payment
  • Submit malicious content, spam, or prompt-injection payloads intended to abuse the AI
  • Infringe on any third party's rights, including the intellectual property of Disney, Universal, or others
  • Share your account credentials with others

9. Your content

You retain ownership of the information you submit (trip details, chat messages, etc.). You grant ParkCharter a limited, worldwide, non-exclusive license to host, process, and display that content solely to operate and improve the service. We do not sell your content and do not use it to train third-party AI models.

10. Our content

The ParkCharter name, logo, software, design, and original text are owned by ParkCharter and protected by intellectual property law. You may use AI-generated itineraries for your personal travel planning. You may not republish, resell, or use them to train competing AI systems.

11. Service changes and availability

We may modify, suspend, or discontinue any part of the service at any time. Some data sources (live wait times, park schedules) depend on third parties and may be unavailable or delayed. We do not guarantee uninterrupted or error-free service.

12. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated content. You use the service at your own risk.

13. Limitation of liability

To the maximum extent permitted by law, ParkCharter's total liability for any claim arising from or relating to the service will not exceed the greater of (a) the amount you paid ParkCharter in the 12 months before the claim, or (b) $50 USD. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost trips, missed reservations, ticket costs, or travel expenses.

14. Indemnification

You agree to defend and indemnify ParkCharter against claims arising from your misuse of the service, your violation of these Terms, or your violation of any third-party right.

15. Termination

You may stop using the service at any time and request account deletion by emailing support@parkcharter.app. We may suspend or terminate your access if you violate these Terms or for legal or security reasons. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) will survive termination.

16. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law rules.

17. Binding arbitration and class action waiver

Please read this section carefully. It affects your legal rights.

Binding arbitration.Any dispute, claim, or controversy arising out of or relating to these Terms or the service (a “Dispute”) will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in Massachusetts or, at your election, in your county of residence, or remotely by video or phone. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and ParkCharter each agree that Disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class action waiver is found unenforceable, then the entirety of this Section 17 will be null and void, and the Dispute will proceed in court under Section 18.

Exceptions.This Section does not apply to (a) claims that qualify for small claims court, or (b) either party's right to seek injunctive or equitable relief in court to protect intellectual property rights.

30-day opt-out.You may opt out of this arbitration agreement by emailing support@parkcharter.app within 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out” and your account email in the body. Opting out does not affect any other provision of these Terms.

18. Court jurisdiction (if arbitration does not apply)

For any Dispute not subject to arbitration under Section 17, you and ParkCharter agree to the exclusive jurisdiction of the state and federal courts located in Massachusetts, and waive any objection to venue in those courts.

19. Changes to these Terms

We may update these Terms. If changes are material, we will notify you by email or in-product notice. Continued use after changes take effect means you accept the new Terms.
